Dominic and Genevieve Hadeed have been ordered to be immediately released by the court after spending 22 days in custody since their arrest on June 24.
In a virtual ruling delivered by Justices of Appeal Peter Rajkumar, Mira Dean-Armorer and Joan Charles a short while ago, the couple was placed under house arrest and must remain at their home on Pine Avenue, Bayshore, Westmoorings.
In addition to being fitted with ankle monitors, the couple must surrender their passports and other travel documents, all firearms in their possession, and all communication devices.
They are not to communicate with persons outside the address, either directly or indirectly, without the prior approval of the Commissioner of Police, and they are to remain at their home on Pine Avenue and must not attempt to leave without the Commissioner’s permission.
They are also not permitted to have visitors at the address without the prior approval of the Commissioner of Police. Only approved medical and legal practitioners and/or caregivers may enter the property.
They must allow authorised members of the Trinidad and Tobago Police Service to enter the premises at reasonable times to conduct inspections and confirm compliance with the conditions. Should either party breach any of the conditions, he or she will be liable to detention under the respective Preventive Detention Orders.
The respondents, including Commissioner of Police Allister Guevarro, Homeland Security Minister Roger Alexander, Attorney General John Jeremie and PC Eldon Calliste, are at liberty, upon delivery of the judgment, to indicate what, if any, further conditions should be imposed.
The Hadeeds indicated that they are prepared to be fitted with electronic monitoring devices to record their movements.
